Teach Soap

I was wondering if anyone had any insight / info on how product name copyright works?

I want to give a fun name to the detangler so I can eventually include it at the kids markets I do. So instead of just 'detangler', I would like to call it the 'Tangle Wrangler' Hair Detangler. The problem is, the 'Tangle Wrangler' is already in use .... for a hair brush... for HORSES! I've searched numerous websites and all over google and it's definitely a horse item.

So, how does this work? In a way it's like calling a soap 'Stary Night' Soap. Everyone knows it's not the painting, and it's more a title I guess. But the last thing I want to do is go causing problems for myself.

Can you take a look at their copyright somewhere? Some register or copyright their name for a wide range of products, not just one. If theirs is for just a hair brush, you might be ok, but don't quote me on it.

I know the US has a copyright info web site that's searchable. Have you checked if Australia has one too?

I knew a doctor that was going back to school to become a copyright lawyer. He was telling me that it is quite extensive to do a copyright search as there are a lot that are applied for everyday. I would think you would have to find the name of the company that makes it. Many people will change a name just a little to get by. Copyrights only last for so long and then a name becomes public domain.

Ended up ringing my lawyer. Thank the universe my divorce lawyer just happened to choose Copyright Law as her electives!!

When I was looking up copy writes to make sure the name I wanted for my business wasn't taken it seemed like if you didn't keep up with your copy write that it would expire 10 years from the date you applied for it.

I know there is a 10 year rule for prescription medications.... and for some reason I do not think they are allowed to renew. Thats where the generics then come into play. Maybe for other things the extension is ok to do as it would not have an adverse affect on someones health. 500 dollars is quite a bit to put down for a name... does that cover all of your soap names as well?

I can see why you would want to.... but for someone who is just doing this as a hobby, it really is not worth it.
As a side note I just learnt that one of the major medications: plavix or clopidegrel, used for patients that have had a stent placed in their heart has become available in generic form! This changes the cost from 195.00 down to 5.00 a script! YeY! In my profession this is a happy day...
