Well what the WSP owner says is quite a bit different than what the bill actually says, at least the parts written about in the post that SB linked to. SO again, it is say one thing, promise one thing, and do another.
Here is the note from WSP;
"update 6/24/2011: I have been informed that the official bill was introduced into Congress as Bill HR 2359. To view the bill yourself go the Thomas Library website and search for HR 2359. I am sure it will be available online very soon. www.Thomas.gov"

We ALL need to contact our representatives and tell them we don't want this passed!

What is the reasoning for wanting this bill to go down in flames?

I think more enforcement on labeling should be.

Too many people say their product is organic, when it is clearly not. I called once on this and was told that they did not enforce the regs.

Do I understand that the bill has not passed yet?

As a scientist, I know that to use this new labeling scheme acurately is impossible. How is it that the writers of the bill don't know this?

I hope it does not pass.

I doubt that the bill could ever pass. It was written by the Democrats with a Republican congress

I am really glad that someone started this thread, i have been trying to read up on this. I started to read the bill the other day. While I appreciate the breakdowns from the good folks over at PCT I like to read things for myself too. I do have a couple of questions about a couple items i saw on the actual bill that have not been discussed yet but maybe someone can shed some light on them, perhaps I am misinterpreting their meanings.

In 2 different spots there is language addressing small and "microbusinesses." By their definition a microbusiness is: MICROBUSINESS- The term `microbusiness' means a business--

`(A) that is engaged in the manufacturing or packaging of cosmetics; and

`(B) that has annual sales receipts for cosmetic products that do not exceed $2,000,000.

And i will add the two sections i have questions about so i don't put them here incorrectly:

This part deals with registration:
(1) IN GENERAL- Beginning 1 year after the date of the enactment of this subchapter, and annually thereafter, any establishment (except for microbusinesses) engaged in manufacturing or packaging cosmetics for use in the United States shall register with the Secretary and pay to the Secretary the applicable fee, as established under the fee schedule in subsection (e).

this part is under section 614 Safety Standard and good manufacturing practices:
(2) CONSIDERATION OF SMALL BUSINESS- In developing the guidance under paragraph (1), the Secretary shall consider how such practices will impact small businesses.

Now, please, I want this to be a constructive thread post with good dialog so please don't jump down my throat. I have not read through the whole bill but hope to (it's boring, i admit).

I am not saying two little sections make this a good bill but I feel like the people who are extrapolating certain parts may have their own agenda in mind, i.e. they are large manufacturers who have more at stake- not specifically PCT but i have another one in mind who has been crying wolf a whole lot which raised my red flag. I know that crap flows downstream so the larger manufacturers that have to conform and do a bunch of testing will just up their prices and we will have to re-price accordingly.

Here's where i get crucified.....on the flip side a lot of fly by night companies will fold up and pick something else to peddle.

One last question which I don't have clarification on is about soap. It remains a separate item correct? As in it's not part of this bill, would there be an cost effect on our raw soapmaking materials due to the new bill regs.?

My last note on this is that there's no way they will be able to enforce such a stringent bill among small time crafters. I think back to the whole "everyone will be required to have health care" ordeal, it's cute, but what are they going to do run around and check everyone's health insurance cards???? Spare me.

So there, my questions are out there, again i am totally open to constructive comments and not personal attacks. I am done and dreaming of moving further and further off the grid......lol

Citymouse, from my understanding nobody is exempt from the labeling regulations, even the micro businesses that are exempt from the registration fees. And from my understanding, soap is no longer exempt either.

I am only part way through the bill, because, as you said, it is boring so I got sleepy. But I read enough to know that it is ridiculous. The thing about what you said about enforcement is that I do not break the law, even when I dont think I will be caught, and I don't feel that is a way to run my business. Besides that, there is always the chance that you will be caught, or reported and investigated. Shoot, I know some people that would take great pleasure in reporting non-compliant companies just to watch someone squirm. Never underestimate the nastiness of some humans. Seriously, we live in a world where a woman can kill her child and get off scott free, a celebrity can kill his wife and her friend and get off free, then write about the fact that he actually did do it, and someone can put a cup of hot coffee between their legs, spill it, then sue the company they bought the coffee from, and actually win! We live in a messed up world for sure!

As far as I've read (about 3/4ths of the bill) and understand (though I do have a hard time with the legalize), the only thing that the "microbusinesses" would be exempt from is the registration fees... they would still have to comply with the other regulations including but not limited to lab testing of their products, labeling ingredients down to the nanometers, and filling out the same type of supplier paperwork as the bigger businesses do...
