So why would that be any different than say using the shape of Mickey Mouse?

Because a lego block is just a building block. Duplo, Lego, etc... they're all just building blocks that snap together. My 'lego' soaps for example are sold as 'boys blocks' at the Market.

Mickey mouse however is a very distinct shape. Pretty much everyone knows it, and even calling it something different, people would know who it is.

Yep, the ears are very well known. That's why Disney has copyrighted them.

I believe Disney has one of those copywrites that where anything designed for Disney is automatically copywrited by Disney. So they don't have to put individual ones on each character (or whatever) they create. Disney has actually had issues with the Mickey Mouse copywrite in the past few years. You can go read about it all over the net. Trust me thought don't go into it, really complicated and it's a he said she said thing.

On a cool note I went to Six Flags over Texas with my sister and some friends to celebrate my birthday which is technically today but whatever. I brought home 3 things... a batman guitar pick, a batman cape that my sister won me.. that's right a batman logo ice cube mold! I can't wait to make soap with it! I knew when I bought it I wasn't going to sell anything but I could say nay nay I have batman soap and you don't. That and it would look awesome in my shower.

So, did lego not copyright the building block they made or were they not the first to develop it. Probably just copyrighted the name. Now could you imagine if someone had copyrighted the puzzle shape?
